In response to its concern about the impact of climate change the Queensland Government has introduced new legislation, to commence 1 January 2010, requiring Sellers of houses and apartments to provide certain information to prospective buyers in respect to:
Under the new legislation real estate agents and private sellers cannot publish an advertisement for the sale of property unless the advertisement includes information about where a copy of the relevant information can be obtained.
The requirements excludes advertisements published in newspapers and magazines and non specific signs, eg. Generic "For Sale" signs.
A prospective buyer is entitled to view the information (the Sustainability Declaration) and during open inspections, a copy of the Sustainability Declaration is to be visibly displayed at the site.
The aim of the declaration is to increase awareness about the sustainable housing features when a property is marketed for sale and to promote the ongoing financial benefits of energy, water and similar measures in the dwelling.
